The Clean Indoor Air Act (CIAA) prohibits smoking in indoor common areas of multi-unit residences, but private residence areas are excluded from this regulation.

Whenever smoking is permitted somewhere in a building, adjacent or nearby apartments are susceptible to secondhand smoke (SHS) that drifts with air currents through ventilation and heating ducts, through cracks and gaps in ceilings and walls, under doors and out of windows. If a tenant can smell cooking odors from another apartment, there is a good chance they would be subject to SHS exposure.

Smoke-free housing means multi-unit dwellings in which smoking is not permitted in any residence, hallways or common areas. For additional protection, balconies, terraces and entryways should be smoke-free to prevent smoke from drifting into open windows and doors. A fully smoke-free property controls litter and allows all tenants to take full advantage of their home's amenities.

In addition to SHS exposure, toxic residue from tobacco use clings to walls, carpets, drapery and furniture posing a hazard to all tenants that follow a smoker in an apartment. Recently this has been named "Third-hand smoke" and its hazards confirmed. Children are especially at risk.

A smoke-free apartment building means, at minimum, that all dwelling units within the building are rented/ leased/ occupied as no smoking anywhere within the dwelling unit. Applies to tenant, all household members, all guests & visitors; all dwelling units vacant, tenant occupied, owner occupied; all service, maintenance and construction personnel. All indoor common areas are covered under the Clean Indoor Air Act of 2003.
