Published on July 22, 2025

On July 22, 2025, at 1:51 AM, Tompkins County Sheriff's Deputies were investigating an unrelated complaint when they heard multiple gun shots being discharged in the area of East Malloryville Road and Gulf Hill Road in the Town of Dryden.  Shortly after, the Tompkins County 911 Center received a call reporting gun shots in the same area and a vehicle speeding off toward Gull Hill Road.

Moments later, Deputies observed a 2008 Mercedes with an equipment violation and speeding on Gulf Hill Road.  Deputies stopped the Mercedes and observed a 12-gauge shotgun in plain view and identified the driver as Dylan M. Damstetter, age 18 of Cortland, NY.  The passenger was identified as Daryen J. Bethel, age 18 of Cortland, NY.

Deputies located spent shell casings in two areas of East Malloryville Road, which was within 50 yards of an occupied residence.  No injuries to persons or damaged property were reported at this time.  These similar casings were also located in the defendant's vehicle along with an open container of alcohol.

Damstetter and Bethel were both charged with Reckless endangerment 2nd degree (Class A Misdemeanor) and Underage Possession of Alcohol (Violation).  Damstetter and Bethel were released on an appearance ticket and are set to appear in the Town of Dryden Court on August 11, 2025, at 5:00 PM.

The New York State Department of Environmental Conservation will be assisting the Sheriff's Office with this case and further charges are pending.
