TC BOH Issues Penalty to Asteri Ithaca LLC; Violation of Health Orders

In executive committee on Thursday, April 9, 2026, Tompkins County’s Board of Health (BOH) unanimously agreed to adopt resolution ENF-26-005 which enforces a $40,000 penalty to Asteri Ithaca LLC. The penalty is for violations of Commissioner of Health orders that were issued at the end of January 2026, following a number of violations and complaints dating back to July 2025. 

Asteri Ithaca LLC is the property owner and operator of Asteri Ithaca, a residential building with 181 residential housing units, receiving government financial assistance for 40 supportive housing units.

Resolution ENF-26-005 gives Asteri Ithaca LLC until April 30, 2026, to comply with the Commissioner's order in full, which includes complete implementation of their solid waste management plan. Asteri’s solid waste management plan includes (but is not limited to) orders to:

  • provide sufficient, professional security, cleaning and maintenance staff;
  • provide adequate and accessible containers for collecting refuse, with plans for proper maintenance;
  • provide prompt attention to the cleaning and removal of biohazards and refuse; and
  • implement a variety of systems and measures for enhanced building safety and security.

Tompkins County Whole Health’s Environmental Health Division will resume routine and frequent inspections of the Asteri property on May 1, 2026 to ensure compliance with these orders. If subsequent violations are found, Tompkins County Whole Health will pursue a penalty of $2,000 per violation per day and seek an additional $9,000 penalty, which has been deferred from this initial enforcement action.
